Information about processing of personal data by MIDPOINT CONNECTIONS.

1. Introductory Provisions
1.1. This Personal Data Processing Information ("Information") is a document serving the purpose of fulfilling the information obligation pursuant to Article 13 and 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR").
1.2. The Information provides all information regarding the processing of personal data of data subjects who use MIDPOINT CONNECTIONS or who have registered on the website www.connections.midpoint-institute.eu.
1.3. Unless stated otherwise, all terms starting with a capital letter have the meaning defined before the parenthesis introducing the term in this Information.

3.1. The data controller of personal data is the operator of MIDPOINT CONNECTION, the Academy of Performing Arts in Prague (Akademie múzických umění v Praze), a public tertiary school regulated by Act No. 111/1998, as amended, with its registered address at Malostranské náměstí 259/12, 118 00 Praha 1 – Malá Strana, Czech Republic, Org. ID No: 61384984, Tax ID No: CZ61384984.

4. Registration and Use of MIDPOINT CONNECTIONS – MIDPOINT Alum Talents
4.1. Purpose: If a subject, in the form of a talent, expresses interest in having their data published within MIDPOINT CONNECTIONS, their personal data is processed for the purpose of technical registration, management of talents in the MIDPOINT CONNECTIONS database, publication of contacts within MIDPOINT CONNECTIONS, and for other functions of MIDPOINT CONNECTIONS. The purpose also includes sending necessary technical messages related to MIDPOINT CONNECTIONS.
4.2. Legal basis for processing: Consent, which is provided voluntarily and informed. Consent can be revoked at any time. Providing data is voluntary, but without providing it, it is not possible to register and publish contacts within MIDPOINT CONNECTIONS.
4.3. Categories of personal data subjects: Identification data, contact data, data concerning professional experience (education, experience, projects, awards including references, motivational information), data on granted consent, and data concerning the use of MIDPOINT CONNECTIONS, login data, network identifiers, MIDPOINT CONNECTIONS settings logs, communications, submitted requests, and all necessary data for the functionality of MIDPOINT CONNECTIONS and receipt of messages. The following data is disclosed within MIDPOINT CONNECTIONS: mandatory email, mandatory name/surname, voluntary company name/address, mandatory CV (experience, projects (title, duration, role (screenplay, directing, dramaturgy), awards (festivals) and log line (plot description), mandatory writing format (e.g., feature/short), mandatory genre (comedy, drama, etc.), mandatory photograph, mandatory language, mandatory country of operation, voluntary social networks (linking profile to IG, FB, LN - browser link to the person's profile), mandatory motivational field - what makes me unique (description of why producers should choose this particular talent), mandatory field with information about the talent, on which projects they would like to collaborate, voluntary references (published recommendations - if filled in, the talent is obliged to obtain the subject's consent to publish their personal data and references and provide it upon request), voluntary attachments (script samples, etc. - talent is obliged to have rights cleared and there is no liability for misuse).
4.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, accounting services.
4.5. Period for which personal data will be stored: For the duration of the account in MIDPOINT CONNECTIONS, but not longer than the account is canceled or consent is revoked. Personal data may be stored longer only if justified by a legitimate interest or legal obligation of MIDPOINT Institute according to this Information;
4.6. Source of data: MIDPOINT CONNECTIONS user.

5. Registration and Use of MIDPOINT CONNECTIONS – Visitors, Professional Public
5.1. Purpose: For the purpose of identifying suitable talents for their own projects or various forms of cooperation, registration for MIDPOINT CONNECTIONS is available for the professional public, companies, i.e., visitors to MIDPOINT CONNECTIONS interested in obtaining contacts for selected talents. Personal data of these visitors are processed for the purpose of technical registration, including all functions of MIDPOINT CONNECTIONS. The purpose also includes sending necessary technical messages related to MIDPOINT CONNECTIONS.
5.2. Legal basis for processing: Consent, which is provided voluntarily and informed. Consent can be revoked at any time. Providing data is voluntary, but without providing it, it is not possible to access contacts within MIDPOINT CONNECTIONS.
5.3. Categories of personal data subjects: Identification data, contact data, visitor-related data, data on granted consent, and data concerning the use of MIDPOINT CONNECTIONS, login data, network identifiers, MIDPOINT CONNECTIONS settings logs, communications, submitted requests, and all necessary data for the functionality of MIDPOINT CONNECTIONS and receipt of messages.
5.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, accounting services.
5.5. Period for which personal data will be stored: For the duration of the account in MIDPOINT CONNECTIONS, but not longer than the account is canceled or consent is revoked. Personal data may be stored longer only if justified by a legitimate interest or legal obligation of MIDPOINT Institute according to this Information;
5.6. Source of data: MIDPOINT CONNECTIONS user.

6. Registration Verification - DOUBLE OPT-IN
6.1. Purpose: For the purpose of verifying registration, an email address verification is performed via an email sent after registration confirmation. Registration is completed only if the link in the confirmation email is confirmed. The confirmation email is sent once, and the link is valid for two weeks. Personal data is stored for the purpose of verifying the existence of the email, data accuracy, and the fact that the user genuinely wishes to complete registration in MIDPOINT CONNECTIONS.
6.2. Legal basis for processing: Legitimate interest against which objections can be raised. Providing data is voluntary, but without providing it, registration in MIDPOINT CONNECTIONS cannot be completed.
6.3. Categories of personal data subjects: Identification data, contact data, data concerning confirmation message, data on granted consent.
6.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, and accounting services.
6.5. Period for storing personal data: Two weeks if the link is not confirmed. If the link is confirmed, personal data is stored for the duration of the MIDPOINT CONNECTIONS registration account. Personal data may be stored longer only if justified by a legitimate interest or legal obligation of MIDPOINT according to this Information;
6.6. Source of data: MIDPOINT CONNECTIONS user.

7. Advertising - MAKE A CONNECTION
7.1. Purpose: For the purpose of enabling the publication of professional advertising within MIDPOINT CONNECTIONS, both for talents and visitors, the MAKE A CONNECTIONS feature is established. Advertiser's personal data is processed for the purpose of technical support for advertising reception and its publication within MIDPOINT CONNECTIONS. The purpose also includes sending necessary technical messages related to advertising in MIDPOINT CONNECTIONS.
7.2. Legal basis for processing: Consent, which is provided voluntarily and informedly. Consent can be revoked at any time. Providing data is voluntary, but without it, advertising within MIDPOINT CONNECTIONS cannot be published.
7.3. Categories of personal data subjects: Identification data, contact data, data concerning the advertiser, data on granted consent, and data concerning the use of MIDPOINT CONNECTIONS, login data, network identifiers, MIDPOINT CONNECTIONS settings logs, communications, submitted requests, and all necessary data for the functionality of MAKE A CONNECTION and receipt of messages.
7.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, accounting services.
7.5. Period for which personal data will be stored: The advertisement is published for the duration chosen by the advertiser and is internally stored for control purposes for one year. The advertisement is not published longer than the consent is revoked. Personal data may be stored longer only if justified by a legitimate interest or legal obligation of MIDPOINT Institute according to this Information;
7.6. Source of data: MIDPOINT CONNECTIONS user.

8. MIDPOINT Institute‘s Legitimate Interests
8.1. Purpose: If MIDPOINT Institute conducts the above-mentioned processing, then after their completion, it collects a limited set of documents and personal data for the purpose of protecting its own rights, defending against claims asserted, and also for the purpose of defense in judicial/administrative/control and other proceedings and for the purpose of ensuring internal compliance control with effective legal regulations, including checks and audits;
8.2. Legal basis for processing: MIDPOINT Institute‘s legitimate interest in ensuring internal compliance, protecting its rights, demonstrating compliance, and defending against supervisory authorities. You have the right to object to this legitimate interest at any time;
8.3. Categories of affected personal data: Documents proving legal acts such as granted consents, relevant logs, submitted requests for rights, etc.; in the case of communication, it also includes identification and contact details and data related to the communication.
8.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, accounting services.
8.5. Period for which personal data will be stored: MIDPOINT Institute retains such data collected for a period of 3 years after the expiration of the processing period specified for another purpose in this Information. The period shall not end before commenced court or other proceedings and related deadlines for remedies.
8.6. Source of data: Subject.

9. Fulfillment of Legal Obligations
9.1. Purpose: If MIDPOINT Institute is required by effective legislation to store specific documents, it does so for the purposes specified by the relevant legal regulation. An example is the storage of documents in the field of accounting and taxes;
9.2. Legal basis for processing: Fulfillment of legal obligation;
9.3. Categories of affected personal data: Only such data or documents whose storage is prescribed by specific legal regulations;
9.4. Recipients: Only contractually authorized processors from the following categories: technical solution providers, IT services, auditors, legal services, accounting services;
9.5. Period for which personal data will be stored: MIDPOINT Institute stores such data only for the period specified by the relevant legal regulation;
9.6. Source of data: Subject.

10. Rights of Data Subjects and Methods of Exercising Rights
10.1. To ensure an adequate level of data processing security and personal data protection, MIDPOINT has adopted appropriate technical and organizational measures that follow the current development of technical means contributing to the security of personal data processing, primarily to prevent unauthorized access to personal data, their theft, or misuse.
10.2. In all processing of personal data, the user as the data subject has rights guaranteed by this article.
10.3. Right to access personal data - the right to have MIDPOINT Institute promptly provide you with information about which of your personal data are being processed, their purpose, recipients, duration, and information on rights.
10.4. Right to rectification - the right to have MIDPOINT Institute promptly correct inaccurate personal data or complete missing ones.
10.5. Right to erasure ("right to be forgotten") - the right to have MIDPOINT Institute promptly erase personal data concerning you;
10.6. Right to restriction of processing of your personal data - the user's right to have MIDPOINT restrict processing if the requirements of Article 18 of the GDPR are met (for example, accuracy of data is denied, objection is raised, etc.).
10.7. Right to data portability - the right to obtain personal data concerning you that you have provided to MIDPOINT Institute and that are processed automatically based on your consent or contract, in a structured, commonly used, and machine-readable format, the right to transfer this data to another controller, and the right to have personal data transmitted directly to another controller, where technically feasible.
10.8. Right to object to the processing of personal data concerning you. MIDPOINT Institute does not process personal data further if it does not prove compelling legitimate reasons for processing that outweigh your interests or rights and freedoms, or for determining, exercising, or defending legal claims. If personal data are processed for purposes of legitimate interest, you have the right to object to the processing of your personal data at any time.
10.9. Right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection, located at Pplk. Sochora 727/27, 170 00 Prague 7 - Holešovice, www.uoou.cz.
10.10. You have the right not to be subject to a decision based solely on automated processing, including profiling, which has legal effects on you or similarly significantly affects you. MIDPOINT Institute does not base any of its decisions solely on automated processing.
10.11. You can request, free of charge, partial or complete erasure of your personal data or blocking, or request information about the data about you stored with us, and request correction of this data. For this purpose, you do not need to use any specific form; it is sufficient to contact us at the above contacts.
10.12. We will process all your requests without undue delay, in justified cases no later than within 30 days.
10.13. If you exercise your rights as a data subject against MIDPOINT Institute as a controller or in case of any requests, inquiries, or complaints regarding the processing of personal data, please use our contacts above.

11. Final Provisions
11.1. The legal system of the Czech Republic governs processing of personal data.
11.2. This Information is effective from April 18, 2024.
11.3. MIDPOINT Institute has the right to change this Information if necessary. The change is effective on the day of notification or on a later date specified in the change notification.

2. Introduction Clause
2.1. These Terms of Use of MIDPOINT CONNECTIONS ("Terms") are intended for all users of the MIDPOINT CONNECTIONS interface ("MIDPOINT CONNECTIONS"), whether they are talents, visitors, or advertisers ("User"), including all holders of a MIDPOINT CONNECTIONS user account ("User Account").
2.2. The MIDPOINT CONNECTIONS interface and user account are established and operated by the Academy of Performing Arts in Prague ("MIDPOINT INSTITUTE"), a public tertiary school pursuant to Act No. 111/1998, as amended, with its registered seat at: Malostranské náměstí 259/12, 118 00 Praha 1 – Malá Strana, Czech Republic, Org. ID No: 61384984, Tax ID No: CZ61384984.

2.4. By using MIDPOINT CONNECTIONS, the User Account, and advertising, the User agrees to and undertakes to comply with these Terms. The User is also informed and acknowledges all information regarding the processing of personal data available in the Privacy Policy ("Policy").
2.5. Acceptance of these Terms constitutes a contract for the provision of MIDPOINT CONNECTIONS services and a User Account between the User and MIDPOINT INSTITUTE, the content of which is defined by these Terms. The content of all services is provided free of charge unless the User is notified in advance of a paid service and agrees to it by accepting separate terms for such service.
2.6. The purpose of these Terms is the comprehensive and proper regulation of the rights and obligations of the User and MIDPOINT INSTITUTE under the contract for the provision of MIDPOINT CONNECTIONS services and a User Account. By accepting the Terms, the User declares that they understand and agree to all provisions.
2.7. If the User has any questions before accepting the Terms, they shall contact MIDPOINT INSTITUTE using the above contacts.

3. Users
3.1. MIDPOINT CONNECTIONS and the User Account are intended without limitation for all individuals ("User") interested in utilizing the services of MIDPOINT CONNECTIONS or a User Account.
3.2. The use of services by Users under the age of 15 is subject to the consent of their legal guardian. By granting consent, the legal guardian accepts these Terms and acknowledges the Privacy Policy.

4.MIDPOINT CONNECTIONS
4.1. The purpose of MIDPOINT CONNECTIONS is to provide access to a database for presenting MIDPOINT Talents Alum.
4.2. The database includes the Talent Pool Gallery, where profiles of MIDPOINT Talents Alum are displayed, and the MAKE A CONNECTION section, which provides space for posting advertisements such as requests/offers ("Dashboard").
4.3. Producers or other database visitors ("visitors") will not be displayed in the Talent Pool Gallery; they only have access to profiles of MIDPOINT Talents Alum in the Talent Pool Gallery and can also post advertisements in the MAKE A CONNECTION section.
4.4. Contact and professional information will be displayed or published in the database only for profiles of MIDPOINT Talents Alum ("talents").
4.5. Access to the database is contingent on login credentials; therefore, everyone must register, whether a visitor or a talent.
4.6. Registration is tailored based on whether the registrant is a MIDPOINT Talents Alum or a producer/other visitor to the database.
4.7. MIDPOINT CONNECTIONS has the following features:
4.7.1. Visitors are authorized to view profiles within MIDPOINT Talents Alum.
4.7.2. Talents are authorized to publish their profiles within MIDPOINT Talents Alum.
4.7.3. All users are authorized to utilize advertising within MAKE A CONNECTION.
4.8. The main functionality is the standalone database of MIDPOINT Talents Alum. It is a database with precise filtering elements, allowing visitors to filter exactly who they are looking for. Filtering elements include names, countries, languages, genres, and formats.
4.9. The second main functionality is the section for advertising MAKE A CONNECTION ("Dashboard"). It is a space for posting offers and requests for collaborations, such as on new projects.
4.10. The user undertakes to protect their access credentials and passwords and to regularly change them.
4.11. In the event of loss or theft of the mobile device where passwords are stored, it is necessary to immediately change the access credentials to the User Account.

5. User Account – MIDPOINT Talent Alum
5.1. The purpose of the User Account is to create a public user profile for the clear provision of professional information, contact details, and other information to visitors.
5.2. By confirming registration, the User grants consent, in the event of the publication of their photographs, in accordance with § 84 et seq. of the Civil Code, to the publication of their likeness, identity, and related information within the MIDPOINT CONNECTIONS platform for the entire duration of the user account.
5.3. By confirming registration, the User grants a license for the use of all works within the meaning of copyright law within the provided information, without limitation as to time, place, or method of use, all for the purposes of MIDPOINT CONNECTIONS under these Terms.
5.4. The User – talent undertakes to provide all details truthfully, completely, and accurately during registration. The talent is obliged to fill in all mandatory fields. Within individual fields, the talent must always provide relevant information related to the field name. If any false or misleading information is discovered, the profile may be blocked or removed.
5.5. The talent is not authorized to provide any personal data or photographs of third parties within the provided information unless they have documented consent, which they undertake to provide to MIDPOINT INSTITUTE upon request at any time.
5.6. The talent is not authorized to publish any works for which they are not the author or do not have a valid license.
5.7. The MIDPOINT Talent Alum database is a database of graduates of MIDPOINT programs for selected professions, namely – Writer, Script Consultant, Development Executive.
5.8. The User will have their profile displayed in the Talent Pool Gallery.
5.9. Additionally, the User is authorized to access the MAKE A CONNECTION section.
5.10. Access to the database is subject to registration, which must be approved by the Admin. Registrations that do not comply with these Terms will not be approved.
5.11. Each User may have only one profile. MIDPOINT INSTITUTE reserves the right to delete duplicate profiles.
5.12. The public part of the talent's profile includes, in particular, the following information:
5.12.1. Basic information – name, surname, country, language, biography, and photograph, email,
5.12.2. Writing format – the format they specialize in,
5.12.3. Genre – the genre they specialize in,
5.12.4. Social media (Instagram, Facebook, LinkedIn, etc.),
5.12.5. Tag – MIDPOINT alumni program,
5.12.6. List of work experiences, previous projects,
5.12.7. Educational programs the talent has participated in,
5.12.8. What makes the talent specific – creative text section,
5.12.9. Projects the talent would like to collaborate on,
5.12.10. References,
5.12.11. Script sample or any other material.
5.13. Inactive profiles will be deleted after two years.
5.14. If the User forgets their password, they can request a password reset. In such a case, a password reset link will be sent to the user's email, and the user will be prompted to enter a new password. Passwords must comply with basic security rules.

6. User Account – Visitors, Professional Community
6.1. The purpose of the User Account is to create a profile for browsing the MIDPOINT Talents Alum database.
6.2. Visitors constitute the professional community database.
6.3. The visitor's profile is not public.
6.4. Access to the database is subject to registration, which must be approved by the Admin. Registrations that do not comply with these Terms will not be approved.
6.5. Each visitor has access to the Talent Pool Gallery and the MAKE A CONNECTION section.
6.6. Each User may have only one profile. MIDPOINT INSTITUTE reserves the right to delete duplicate profiles.
6.7. Visitors are not authorized to download the content of the database, use it for purposes other than those set (i.e., for the purpose of arranging cooperation with the respective talent), pass it on to third parties, or otherwise misuse it. Visitors are not authorized to use any documents available within talent profiles for purposes other than those set by these Terms (i.e., for the purpose of arranging cooperation with the respective talent). Visitors are not authorized to send any unsolicited commercial communications or otherwise violate applicable law.
6.8. In case of a breach of these Terms by a visitor, the User Account will be blocked or removed.
6.9. Inactive profiles will be deleted after two years.
6.10. If the User forgets their password, they can request a password reset. In such a case, a password reset link will be sent to the user's email, and the user will be prompted to enter a new password. Passwords must comply with basic security rules.

7. Registration and Activation of User Account
7.1. The User establishes the User Account in MIDPOINT CONNECTIONS by activating it on the website [https://connections.midpoint-institute.eu/register], by properly and correctly filling in the required information for the specific type of user account.
7.2. To complete the registration, it is necessary to confirm these Terms by clicking the relevant button and to familiarize oneself with the processing of personal data through the Privacy Policy.
7.3. The profile is created by successful activation, which is confirmed by a confirmation email. The confirmation email will arrive after confirming the registration. If not confirmed via the attached link within 14 days, the registration will be canceled.

8. Moderation of User Content
8.1. In accordance with applicable law, MIDPOINT INSTITUTE is obliged and authorized, if necessary, to moderate illegal content.
8.2. MIDPOINT INSTITUTE has implemented procedures for moderating illegal content in accordance with applicable law, including Regulation (EU) 2022/2065 of the European Parliament and of the Council on digital services ("DSA").
8.3. Any user is authorized to report any illegal content.
8.4. In their report, the user sufficiently identifies the reported content, for example, with a copy, screenshot, link, etc., and justifies why they consider the content to be illegal. The report must always contain:
8.4.1. A well-founded explanation of the reasons why the individual or entity claims that the information in question constitutes illegal content;
8.4.2. A clear indication of the exact electronic location of this information, such as the precise URL or URLs, and, if necessary, additional information allowing the identification of illegal content depending on the type of content and the specific type of hosting service;
8.4.3. The name of the person or the name of the entity submitting the report and their email address, except in cases where it is suspected that the information constitutes one of the offenses listed in Articles 3 to 7 of Directive 2011/93/EU;
8.4.4. A statement confirming that the person or entity submitting the report in good faith believes that the information and statements contained in the report are accurate and complete.
8.5. Reports are always submitted to the following contacts:

8.6. If the report contains electronic contact information for the person or entity submitting the report, MIDPOINT INSTITUTE will promptly send them a confirmation of receipt of the report.
8.7. MIDPOINT INSTITUTE will verify each report, determine whether the content is indeed illegal, or whether there are sufficient reasons to designate the content as risky in terms of the inability to document its legality, and act in accordance with applicable law, including moderating such content.
8.8. MIDPOINT INSTITUTE handles all reports promptly, transparently, and non-discriminatorily.
8.9. Illegal content includes any content that is unlawful ("illegal content"), including but not limited to:
8.9.1. Infringement of copyright - for example, uploading and using copyrighted works without the author's consent;
8.9.2. Violation of third-party rights - illegal products including counterfeits;
8.9.3. Violation of applicable law within its content - illegal hate speech, terrorist content, discriminatory content;
8.9.4. Serious criminal offense - sharing child pornography, sharing private images without consent, cyberstalking;
8.9.5. Violation of personal rights - violation of consumer rights, violation of personality rights;
8.9.6. Otherwise violating applicable law, whether civil, criminal, or administrative.
8.10. MIDPOINT INSTITUTE is not responsible for illegal content that has not been identified by the responsible person for the content of MIDPOINT CONNECTIONS. If MIDPOINT INSTITUTE becomes aware of illegal content, it will take steps to remove or moderate it.
8.11. If MIDPOINT INSTITUTE moderates illegal content, it will inform the affected user of the reason. This does not apply if MIDPOINT INSTITUTE does not know the contacts of such a user or if it concerns misleading commercial content in large volumes.
8.12. The affected user (of illegal content) is promptly and comprehensibly informed, particularly about the following:
8.12.1. Information on whether the decision involves removing information, preventing access to it, assigning a worse position in search results, limiting its visibility, or suspending or terminating payments related to this information, and, in relevant cases, the territorial scope of this decision and its validity period;
8.12.2. Facts and circumstances on which the decision is based, including in relevant cases whether the decision was made based on a report or voluntary investigation, and, if necessary, the identity of the notifier;
8.12.3. In relevant cases, information on the use of automated procedures in decision-making, including whether the decision was made with regard to content identified or identified by automated means;
8.12.4. If the decision concerns allegedly illegal content, a reference to the relevant legal basis and an explanation of why the information is considered illegal content for this reason;
8.12.5. If the decision is based on the alleged incompatibility of the information with the MIDPOINT INSTITUTE terms, a reference to the relevant contractual basis and an explanation of why the information is considered incompatible with the relevant provision(s);
8.12.6. Information about available remedies that the user has regarding the decision, particularly through any internal complaint resolution mechanisms, out-of-court dispute resolution, and judicial remedies.
8.13. The user is entitled to object to the moderation of illegal content, and MIDPOINT INSTITUTE undertakes to assess the objections and communicate its findings to the user.
8.14. MIDPOINT INSTITUTE also notifies the person or entity submitting the report of its decision regarding the information in question and provides them with information about available remedies related to this decision.
8.15. If MIDPOINT INSTITUTE suspects possible commission of a criminal offense, it is entitled to inform the relevant authorities.
8.16. The user is not authorized to store, publish, or send any illegal content. Content may be recorded by the user, among other methods, through profiles, advertisements, using the service, using the user account, or any other means of storing, sending, or publishing any content (text, images, videos, etc.). Providing illegal content by the user (publicly or privately) is a serious breach of the Terms.
8.17. Moderation of illegal content includes, among other things:
8.17.1. Editing or shortening of a post;
8.17.2. Removal of a post;
8.17.3. Limitation of the ability to use the service;
8.17.4. Suspension of the ability to use the service;
8.17.5. Restriction of the ability to use the user account;
8.17.6. Termination of the ability to use the user account;
8.17.7. Other necessary steps to prevent the storage of illegal content.
8.18. The user is entitled to contact the entity for out-of-court dispute resolution or to file a complaint with the supervisory authority as follows:

8.18.3. The entity for out-of-court dispute resolution is:
8.18.3.1. CTU for objections to handling complaints about defects in publicly available electronic communication services (§ 64 para. 7 of the Electronic Communications Act), according to § 129 para. 3 of the ZEK, resolving disputes in electronic communications between the service provider and the participant/user (§ 129 para. 1 of the ZEK). 9. Other Rights and Obligations
9.1. MIDPOINT INSTITUTE does not provide any warranties that all services will be flawless, continuously available, and/or free from damage/attack.
9.2. MIDPOINT INSTITUTE is not responsible for the availability of MIDPOINT CONNECTIONS, User Account, and/or their components.
9.3. MIDPOINT INSTITUTE is not liable for the use of MIDPOINT CONNECTIONS by a third party in violation of these Terms.
9.4. The user is not entitled to compensation for any damages incurred while using MIDPOINT CONNECTIONS, User Account, and/or due to their unavailability or malfunction.
9.5. If MIDPOINT CONNECTIONS or the User Account contain links to third-party websites, MIDPOINT INSTITUTE is not responsible for their content or for these links.
9.6. MIDPOINT INSTITUTE owns MIDPOINT CONNECTIONS, graphics, appearance and design, documents, materials, files, works, texts, and all content of MIDPOINT CONNECTIONS. Any reproduction is prohibited.
9.7. Any use of intellectual property rights, content, copyrighted works, trademarks, MIDPOINT CONNECTIONS content, source code, databases except for purposes expressly stated in these Terms requires the written consent of MIDPOINT INSTITUTE.
9.8. The user is not authorized to use MIDPOINT CONNECTIONS in violation of these Terms, for purposes other than those stated in these Terms, or in violation of good morals or applicable law.
9.9. The user is not authorized to attempt to access the systems of MIDPOINT CONNECTIONS or third parties.
9.10. The user is not authorized to infringe on the rights of third parties in any way.
9.11. The user is not authorized to misuse MIDPOINT CONNECTIONS by introducing harmful or technologically exploitable material, gaining unauthorized access, attacking the system, denying service, etc.
9.12. Links to third-party websites are beyond the responsibility of MIDPOINT.

10. Duration of Service Provision, Termination of Contract
10.1. MIDPOINT CONNECTIONS, as well as the User Account, are established for an indefinite period.
10.2. The user is entitled to cancel their User Account and/or MIDPOINT CONNECTIONS at any time without stating a reason. The user initiates the cancellation here.
10.3. MIDPOINT is entitled to terminate the operation of MIDPOINT CONNECTIONS, User Accounts, or parts of the services at any time or to transform them into services with different features. Among other reasons, MIDPOINT INSTITUTE is entitled to cancel or partially cancel services for the following reasons:
10.3.1. MIDPOINT INSTITUTE ceases to provide the services in question or discontinues the operation of User Accounts/MIDPOINT CONNECTIONS or transforms them into others.
10.3.2. The user violates these Terms.
10.3.3. The user engages in fraudulent or unfair conduct towards MIDPOINT INSTITUTE or attempts to circumvent these Terms or acts against good morals.
10.3.4. The user requests the termination of personal data processing for the purpose of managing the User Account or MIDPOINT CONNECTIONS or other services, and without processing personal data, it is not possible to provide the service.

11.Final Provisions
11.1. The operation of MIDPOINT CONNECTIONS and the User Account is governed by the laws of the Czech Republic.
11.2. Any dispute, if not resolved amicably, shall be decided by the competent court in the Czech Republic.
11.3. These Terms are effective as of April 18, 2024.
11.4. MIDPOINT INSTITUTE has the right to change these Terms if necessary. The change takes effect on the date of notification or on a later date specified in the notification of change. The user has the right to reject the changes and terminate the use of the services under these Terms.
